Elli Living — Accommodation Agreement & Terms of Occupancy
This Accommodation Agreement (Agreement) is entered into between Elli Living Pty Ltd (Elli Living, we, us) and the individual completing the booking or check-in process (you, guest).
By completing a booking, confirming your stay through our website or third-party platform, or accessing your room via digital check-in, you acknowledge that you have read, understood, and agreed to be bound by this Agreement.
1. Nature of Occupancy
Elli Living operates a hybrid hospitality model designed to provide flexible, hotel-style accommodation with community-focused shared spaces.
Your stay constitutes a licence to occupy only. It does not create a lease, tenancy, or any right of exclusive possession. Elli Living retains control, management, and access to all rooms and common areas at all times.
To the maximum extent permitted by law, including under the Residential Tenancies Act 2010 (NSW), this Agreement is not intended to create, and must not be construed as creating, a residential tenancy. Where a property is located outside New South Wales, this Agreement is to be interpreted in accordance with the equivalent legislation of that jurisdiction, with the intention that the arrangement remains a licence to occupy.
2. Digital Booking, Check-In and Access
Elli Living operates a fully digital booking and check-in process supported by its property management and guest systems, including Mews and associated applications.
As part of this process, you agree to:
- provide accurate personal details at the time of booking
- complete identity verification, including uploading a valid government-issued identification document
- provide a valid payment method for charges, deposits, and incidentals
- accept digital issuance of room access credentials
Access to your room and building may be granted via mobile key or other electronic method. You are responsible for maintaining the security of your credentials and must not share access with any unauthorised person.
Elli Living may suspend or revoke access where there is a breach of this Agreement or a security concern.
3. Stay Structure and Services
Elli Living offers both short-term and extended stay accommodation.
Short stays (generally under 28 days) are operated in accordance with standard hospitality practices and include periodic housekeeping services.
Extended stays (29 days or more) remain a licence arrangement and are not residential tenancies. Services may be reduced or modified for operational efficiency, and no ongoing housekeeping is included unless otherwise specified.
To maintain the classification of your stay as accommodation rather than a tenancy, Elli Living retains rights of access, control, and service variation throughout your stay.
An end-of-stay cleaning fee applies to extended stays and will be charged to your nominated payment method.
4. Payments, Charges and Security
All accommodation charges must be paid in accordance with the terms presented at the time of booking. Elli Living may require prepayment, staged payments, or recurring billing depending on the length and structure of your stay.
You authorise Elli Living to:
- charge your nominated payment method for accommodation fees, cleaning fees, and any additional services
- place a pre-authorisation hold or security deposit to cover incidentals, damage, or unpaid charges
- recover any outstanding amounts following your departure
Failure to maintain a valid payment method or settle outstanding amounts may result in immediate suspension or termination of your stay.
Fees such as cleaning charges, smoking penalties, and damage-related costs are agreed to be a reasonable estimate of loss and administrative expense incurred by Elli Living.
5. Use of Premises and Community Conduct
You agree to occupy the premises for accommodation purposes only and to comply with all house rules, policies, and directions issued by Elli Living from time to time.
You must conduct yourself in a manner that respects other guests, staff, and the community environment. Quiet hours apply between 10:00 PM and 7:00 AM.
You must not:
- sublet, licence, or transfer your occupancy
- use the premises for unlawful purposes
- cause nuisance, disruption, or damage
- permit unauthorised persons to reside in your room
Elli Living reserves the right to update community standards and operational rules as required.
6. Access, Entry and Operational Control
Elli Living retains the right to enter your room at any time in the case of an emergency, and otherwise on reasonable notice for maintenance, inspection, or operational purposes.
To ensure continuity of operations, Elli Living may relocate you to an alternative room or property where reasonably necessary, including for maintenance, safety, or operational efficiency. Where practicable, relocation will be to a comparable standard.
7. Facilities and Services
Access to shared facilities, including coworking areas, lounges, gyms, and communal kitchens, is provided subject to availability and may be modified or withdrawn at Elli Living’s discretion.
Use of all facilities is at your own risk. Elli Living is not liable for injury, loss, or damage arising from use of equipment or shared spaces, except where liability cannot be excluded by law.
8. Damage, Loss and Insurance
You are responsible for any damage to your room, furnishings, or common areas caused by you or your guests, excluding fair wear and tear.
Elli Living does not accept responsibility for loss, theft, or damage to personal belongings. You are encouraged to obtain appropriate insurance cover.
9. Smoking, Pets and Safety
Elli Living operates a strict non-smoking policy across all rooms and common areas. Where smoking or vaping occurs, a cleaning and remediation fee will apply.
You are responsible for all costs arising from the activation of fire or safety systems due to your actions, including emergency services attendance and associated damage, to the extent permitted by law.
Pets may only be permitted with prior written approval and may be subject to additional conditions and fees. You remain fully responsible for the behaviour and impact of any approved animal.
10. Cancellations and Early Departure
Cancellation and modification terms are as specified at the time of booking.
Short stay bookings typically require a minimum notice period prior to arrival to qualify for a refund.
Extended stays require advance notice for early termination. Charges may apply where notice requirements are not met.
No refunds are provided for unused nights except where required by applicable law.
11. Termination and Removal
Elli Living may terminate this Agreement immediately where you:
- fail to make payment when due
- breach this Agreement
- engage in unsafe, unlawful, or disruptive conduct
- compromise the safety or well-being of others
Elli Living may also terminate or suspend your stay where reasonably required for operational, legal, or safety reasons.
Upon termination, your access may be revoked immediately. Elli Living may remove and store your belongings at your cost and, after reasonable notice, dispose of uncollected items in accordance with applicable law.
12. Limitation of Liability
To the maximum extent permitted by law, Elli Living’s total liability to you is limited to the total accommodation fees paid by you.
Elli Living is not liable for indirect, incidental, or consequential loss, including loss of income, business interruption, or failure of utilities, digital systems, or services beyond its control.
13. Indemnity
You agree to indemnify and hold harmless Elli Living from any claim, loss, damage, or liability arising from your use of the premises, your breach of this Agreement, or any act or omission by you or your guests.
14. Force Majeure
Elli Living is not responsible for any failure or delay in performance caused by events beyond its reasonable control, including natural disasters, government restrictions, utility failures, or similar events.
15. Privacy and Data
Elli Living collects and processes personal information in accordance with its Privacy Policy.
By using Elli Living’s digital systems, you consent to identity verification, data processing, and the use of technology platforms required for access, security, and service delivery.
16. General
This Agreement is governed by the laws of New South Wales unless the property is located in another jurisdiction, in which case the laws of that jurisdiction apply.
This document constitutes the entire agreement between the parties. If any provision is found to be invalid or unenforceable, the remaining provisions continue in full force.
Elli Living may update these Terms from time to time. Continued occupancy constitutes acceptance of any updated Terms.
